Child Support

Child support in Michigan is calculated by formula, not negotiated freely. The arguments are almost always about the numbers that go into it.

Michigan applies a statewide child support formula. Because the calculation is prescribed, there is limited room to simply agree a different figure, and a court is not obliged to accept one the parties propose if it departs from the formula without justification.

What that means in practice is that these disputes are about inputs rather than outcomes. Establish the inputs correctly and the number follows. The inputs that matter are each parent's income, the number of overnights each parent has, health care and child care costs, and the number of children supported.

Where a parent is voluntarily unemployed or underemployed, the formula allows income to be imputed based on earning capacity rather than actual earnings. Taking a lower paying job or reducing hours around the time of a support dispute is a recognizable pattern and it is examined.

Practicalities

How support is administered

Support is generally handled through the friend of the court, and payments typically run through the state disbursement system rather than directly between parents. That is deliberate, because it produces a payment record that resolves later disputes about what was and was not paid.

Direct payments between parents, however well intentioned, frequently cause problems. Money handed over informally may not be credited against the obligation, and a parent can find they are treated as in arrears despite having paid.

Support ordinarily continues until a child reaches majority, and Michigan allows it to continue somewhat longer where a child is still completing high school and meets the statutory conditions.

Questions about support

Can we just agree on an amount between ourselves?

You can propose one, and the court is not required to accept a figure that departs from the formula without a proper basis. Informal agreements outside a court order also tend to fail, because they are unenforceable and the paying parent may still be treated as in arrears.

My ex is self employed and reports almost no income.

This is common and there are established ways to address it. Business records, bank deposits, tax returns and lifestyle evidence can all be examined, and personal expenses run through a business are frequently added back. Loan applications are often the most useful documents, since they usually state income candidly.

I lost my job. What do I do?

Seek a modification promptly. Support does not adjust automatically and arrears continue to accrue under the existing order until it is changed. Waiting is the most expensive response, because past due support is very difficult to reduce retroactively.

What happens if support is not paid?

Enforcement tools are substantial and include income withholding, tax refund interception, license suspension, liens and contempt proceedings. If you are owed support, these are available. If you are behind, addressing it early is far better than waiting for enforcement.
